General conditions of use
Flyrtin is free for all travellers (users). The use of Flyrtin services for the users implies the acceptance of the present general conditions of access and use (“General Conditions of Use”, “GCU” Et.Seg)
The present GCU can be freely modified at any moment, total or partially, and/or complemented by certain specific conditions and modalities of use of determined functionalities and/or of access means, without previous notice or neither later nor prior information. Therefore, it is recommended to the Registered Users to review them on a regular basis.
IT IS CONSIDERED THAT REGISTERED USERS HAVE ACCEPTED THE TERMS AND CONDITIONS OF THE GCU FINAL VERSION WHENEVER THEY LINK TO THE WEB SITE. REGISTERED USERS HAVE ACKNOWLEDGED THAT IN CASE OF BREACH OF THE PRESENT GCU, ACCESS TO THE SERVICE COULD BE DENIED TO THEM.
1. Services description
Flyrtin is a social traveling finder, where the user who anticipates to travel in airplane and wants to take advantage of the flight can meet people and make friends.
The system allows to users who already have a trip in common, in a same flight, to know each other before the day of departure or during the same. This way, it will be able to be known who goes in the airplane that day. Or if it is to travel in airline companies whose airplanes already provide WIFI, can, on real time, in mid-flight interact with the rest of travellers. On the other hand, the flight will be registered and after the same, the users who have made contact with each other will be able to keep doing it, and those that have not done it will be able to even do it later.
Each user will have a profile, with public and private information. The user will show, in the same, the information that wants to be public. This way, the privacy level will be the one that defines each user.
Trips can also be organized, when looking for groups of people who share the same intention to travel in a specific month from a place to another one. This way, it will not be essential to have a purchased airplane ticket to use Flyrtin, since introducing the departure place and destiny, for a concrete month, will be able to form potential travelling groups in which relations settle down, by means of the cultural exchange of information, traveling direction, etc.
2. Admissibility
The making available of Services is strictly reserved to the people with capacity to subscribe contracts in law. The people who want to register in Flyrtin must be therefore over 18 years of age obligatorily fulfilled and enjoy total legal capacity.
Parents: You must control the use that your children make out of Internet. As a legal representative of your children, you have the responsibility to authorize or not the appropriate service to your children and to control the use that they make out of it. The present Web-site offers contacts possibilities that are preferable to avoid to your minor children.
3. Registered users' rights and obligations
In general, the Registered User commits themselves to respect all the legal, law and conventional obligations, as well as the uses and practices to which they are put under.
3.1 Registration
The registered user will define their Nickname and the contact e-mail; the private information e-mail will never be public by any mean.
The registered user will be able to add a digital picture to their profile in order that the other registered users can identify it easier. The digital picture shall can not be of obscene content nor that harms international legislation.
3.2 Confidentiality of the IDs
When registering online, the internaut who wants to use Flyrtin will have to choose their user Nickname and their password. After the registration confirmation, the internaut will receive a confirmation e-mail message having authorized to them to connect them to Flyrtin and to use the Services.
The IDs [Identification Credentials] are personal and confidential. The Nickname of user can only be modified by request of the Registered User sending a message to the following address: info@flyrtin.com.
However, the User will be able to freely modify their password.
The Registered User is totally responsible for their entry data use and commits themselves to make everything it takes to keep them secret and not to disclose them to anybody, including any relatives, irrespective the reason.
In case of IDs loss or theft, the Registered User is the sole responsible of the harmful effects of the loss or theft and will have, in shortest lapse of time, to send a message letting us know of the actual issue to the following address: info@flyrtin.com.
3.3 Contents
Any information, text, image, animated or not, data, sound, file multimedia, page structure, code, function, navigation element, hypertext link, domain name or any other contribution, considered as a whole or separately, will be denominated “Content” in the present GCU.
The Registered User who transmits, spreads, publishes, edits, makes available, shares or discloses any Content, irrespective of modalities, thanks to or through Flyrtin, guarantees that he/she (them) have the right to do it and that the contents in particular do not violate the image right or the right to private life of the people, do not violate nor ignore the third parties intellectual and/or industrial property rights, do not constitute a predicted infraction and repressed by law on press freedom or do not attempt against the innocence presumption.
The Registered User commits him/herself (themselves), in addition, not to spread, to publish, to edit, to make available, to share or to disclose any Content that could constitute anticipated infractions by law, in particular relative treats to minors or older human beings, the procurement, the assimilated infractions and minors prostitution. The Registered User also commits themselves not to record, register nor transmit-directing images or representations of a minor with pornographic character, or to make it available or to share it, of irrespective used means.
On the other hand, the Registered User commits him/herself (themselves) not to do the previously mentioned acts regarding a Content that could constitute direct or hint advertising in favor of tobacco, alcohol or of any substance use or commercialization is restricted or prohibited.
The Registered User also commits themselves not to do the previously mentioned acts regarding a message that could be described as commercial advertizing, or in their own benefit or third parties benefit, whoever they were.
It is stipulated that all the limitations that appear hereinbefore apply to all the Services, are the whoever the addressees were, volunteers or not, of these Contents and whatever its number and quality is.
On the other hand, when using the Services object of the present GCU, it is considered that the Registered User accepts that any Content to be added to their profile can reproduced solely without limitation of duration and with aims of creation, management and administration of the Services or use of one or several Services or simply of Flyrtin consultation.
3.4 Guarantees
The Registered User accepts and recognizes that he/she (*them) is the sole responsible of Contents that could be imputed to them in compliance with the present GCU. The Registered User accepts to assume and to give the Flyrtin publisher of any responsibility, loss, claim, litigation, damage or cost, including the defense and trial whereabouts, vindicated by a third party or any other Registered User due to Contents that could be imputed to them in compliance with the present GCU.
It is specifically stipulated that the sole responsibility of the Registered User due to the Contents and the relevant guarantee could take part, even in the hypothesis that the access to the corresponding Content has been eliminated or restricted by the Registered User in the conditions that himself has determined.
3.5 Information
The Registered User commits themselves to communicate, to e-mail address info@flyrtin.com, any fact or behavior that, to his/her (their) opinion, could bring about the suspension, disturbance or total or partial interruption, irrespective of duration, of the available services in Flyrtin.
In the same way, the Registered User commits themselves to communicate any notification that a third party sends to them refuting the conformity of a Content with the applicable law and in particular with texts mentioned on article “REGISTERED USERS RIGHTS AND OBLIGATIONS” that appear above.
The user accepts the use of e-mail mailbox for information transmission that requests for regarding the conclusion or the execution of the Services.
3.6 Others
The Registered User commits themselves not to use fake IDs, inconvenient or pertaining to third parties when using the Services of Flyrtin. Also, he/she (*them) commits not to manipulate Identifiers (user name, Nickname, etc.) nor the passwords with the purpose of to disguise the Contents real origin.
The Registered User commits themselves, when using Flyrtin Services, to not do any act that limits, prevents or disturbs in anyway, and temporarily, the normal use of these Services by the other Registered Users or the Flyrtin consultation by the other internauts. The previous dispositions are applied to viruses, worms, Trojan horses, as well as to any act that could block partisan or the totality totally or part of the operation of Services or to deteriorate anyway the content of other Registered Users whoever they were.
Also, the Registered User commits themselves not to send trash-mail (“Spam”), chain messages or advertizing messages without authorization.
The Registered User also commits themselves not to request information, to use or to extract Content with the purpose of to create a data base or a Flyrtin identical or similar service, or simply to compete with it.
Indeed, all the Registered Users are informed that Flyrtin and each of its Services, considered separately or as a whole, constitute a data base according to the stipulated in the Intellectual Property.
4. Non-availability of services
Flyrtin Web-site´s responsibility is not jeopardized and therefore it will not be able to undergo any consequence due to the degraded or defective operation of the Services or implemented technical resources, of total or partial non-availability, irrespective of duration of totality or part of the Services or of access to Flyrtin, nor in case of modification, deterioration, alteration or loss of the total or part of a Content.
Flyrtin Web-site and Services which constitute it, are set available to Registered Users without any duration guarantee. The Services could be suppressed partially or totally, even without previous notice and without reason. It is not guaranteed that the Services will be provided of uninterrupted, fast, safe or totally compatible way with the equipment and programs of the Registered User.
5. Responsibility limitation - guarantee
Flyrtin does not grant any guarantee to the Registered Users nor to the internauts on the exactitude or the reliability of the Contents. The Registered User recognizes and accepts that Flyrtin does not assume nor supports any responsibility related to the Contents and is committed to guarantee in the detailed conditions in the part “Guarantees” to him of the denominated “REGISTERED USERS RIGHTS AND OBLIGATIONS” of the present GCU article.
The Registered User commits him/herself (themselves) not to incriminate to Flyrtin, are as the consequences will go, nor to make no complaint to him/her. The Registered User recognizes that served by the publisher of Flyrtin within the framework of the presents consists only of offering the possibility to any internaut of using the Services, but without to be never responsible for the totality or a part of the Content, nor to jeopardize it therefore responsibility before third parties, internauts or Registered Users.
On the other hand, to Registered Users is informed, who accepts that Flyrtin has the faculty to include, where and when wanted, all type of commercial advertising in any of the Services in compliance with the applicable law, without said inclusion could take place to claims by a Registered User.
6. Suppression of contents - terminate
The Registered User is informed and accepts that:
- The Contents can be modified or suppressed partial or totally,
- The totality or a part of any of Services or its totality can be interrupted,
- The faculty can be limited for one of the Registered Users to create or to participate in one or several Services.
Also the user will be able to exert his right to terminate Flyrtin specifically by sending a message to e-mail info@flyrtin.com
7. Applicable law
The present GCU are governed, interpreted and applied in compliance with the Spanish law, excluding any other state legislation.
